The Board approved the meeting minutes from July 10, 17, 24, and 31, 2018, without any corrections.

Consent Agenda

Amendments to planning code and administrative code that were passed.

The Board approved several items on the consent agenda. These items included an ordinance amending the Planning Code to abolish a nine-foot legislated setback on 19th Avenue between Quintara and Rivera Streets and revise the Zoning Map, and another ordinance amending the Planning Code to allow limited nonconforming uses in specified zoning districts to operate between 10:00 p.m. and 12:00 a.m. with Conditional Use authorization. Also approved were ordinances amending the Administrative Code to require disclosure of candidate and third-party spending in Retirement Board, Health Service Board and Retiree Health Care Trust Fund Board elections, and to require city departments to prioritize the processing of 100% affordable housing projects.

Consent Agenda

A new Office of Sexual Harassment and Assault Response and Prevention was established.

Supervisor Ronen requested that File No. 180480 be severed from the Consent Agenda. This file concerned an ordinance amending the Administrative Code to establish the Office of Sexual Harassment and Assault Response and Prevention, which will be responsible for receiving complaints, compelling attendance of city officers, notifying departments of failures, referring officers for discipline, requiring departments to report information, engaging with community members, making reports to the Human Rights Commission, and maintaining confidentiality. The ordinance passed with a unanimous vote.

Unfinished Business

Chinatown is prohibiting cannabis sales in the area.

The Board approved an ordinance amending the Planning Code to prohibit Cannabis Retail and Medical Cannabis Dispensaries in the Chinatown Mixed Use Districts. The vote was 8-3, with Supervisors Brown, Mandelman, and Ronen voting against.

Unfinished Business

Changes in fees regarding accessory dwelling units street tree requirements.

The Board approved an ordinance amending the Planning Code to allow payment of an in-lieu fee for an ADU’s street tree requirement. The vote was 9-2, with Supervisors Fewer and Kim voting against.

New Business

Financing and ground lease resolutions passed for a multifamily housing project.

The Board approved a resolution authorizing the execution and delivery of a multifamily housing revenue note not to exceed $35,712,500 for the construction of an 81-unit multifamily rental housing project at 490 South Van Ness Avenue. They also approved a long-term ground lease with 490 SVN Housing Associates, LP, for the same property, with an annual base rent of $15,000, to construct a 100% affordable, 80-unit multifamily rental housing development.

New Business

The Department of Public Health received retroactive approval for agreements with the California Department of Health Care Services and the Regents of the University of California.

The Board retroactively approved an amended agreement with the California Department of Health Care Services to change the end date of the agreement from April 30, 2018, to June 30, 2017, with no change to the amount not to exceed $238,581,122. Also, the Board retroactively approved an agreement between Department of Public Health, Community Behavioral Health Services, and the California Department of Health Care Services, for the San Francisco Mental Health Plan, for a five year term of July 1, 2017, through June 30, 2022, in the amount of $0. Finally, the Board retroactively approved a contract agreement between the Department of Public Health and The Regents of the University of California, for behavioral health services for adults and older adults for a contract term of four years, from July 1, 2018, through June 30, 2022, in an amount not to exceed $22,811,510.

New Business

Planning Code amendments regarding massage establishments and affordable housing projects.

The Board passed on first reading an ordinance amending the Planning Code to conditionally permit Massage Establishments in the Union Street Neighborhood Commercial District. Additionally, the Board passed on first reading an ordinance amending the Planning Code to permit Affordable Housing on undeveloped lots in Service/Arts/Light Industrial (SALI) Zoning Districts.

New Business

Reclaimed Water Use Ordinance was moved back to the Land Use and Transportation Committee.

The Board voted to re-refer an ordinance amending the Public Works Code to repeal the Reclaimed Water Use Ordinance to the Land Use and Transportation Committee.

Special Order

Posthumous Certificate of Honor presented to Dr. Dawn Bohulano Mabalon.

The Board suspended the rules to grant privilege of the floor and Supervisor Kim presented a posthumous Certificate of Honor to the family of Dr. Dawn Bohulano Mabalon, in recognition of her achievements as a professor, historian, author, scholar, activist, and advocate.

Special Order

Hearing regarding Central SoMa Plan appeal was continued.

The Board held a hearing on the appeal of the Final Environmental Impact Report certification for the proposed Central SoMa Plan. After public comment, the Board voted to continue the hearing to the September 11, 2018, meeting. Consequently, motions affirming, conditionally reversing, and directing the preparation of findings to reverse the certification were also continued to the same date.

Approval of Final Mitigated Negative Declaration was affirmed for the Alcatraz Ferry Embarkment Project.

The Board held a hearing on the appeal of a Final Mitigated Negative Declaration for the Alcatraz Ferry Embarkment Project. After presentations and discussion, the Board voted to affirm the approval by the Planning Commission. Motions conditionally reversing the approval and directing the preparation of findings to reverse the declaration were tabled.

Hearing regarding Conditional Use Authorization for 143 Corbett Avenue was continued.

The Board held a hearing regarding a Conditional Use Authorization for a project at 143 Corbett Avenue. Supervisor Mandelman moved to continue the hearing to the Board of Supervisors meeting of October 2, 2018, which was approved. Consequently, motions approving, conditionally disapproving, and directing the preparation of findings related to the appeal were also continued to the same date.

Public comments were heard on various topics, including discrimination, transit, water supply, and affordable housing.

The Board heard public comments on a variety of topics. Several speakers voiced opposition to a Resolution supporting the Affordable Housing Act. Other topics included discrimination, transit, water supply, public corruption, safe injection sites, religious concerns, public safety, and mental illness experiences.

Resolution opposing California State Proposition 6 was adopted.

The Board adopted a resolution opposing California State Proposition 6 on the November 6, 2018, ballot, which would repeal the Road Repair and Accountability Act of 2017 and require voter approval to impose, increase, or extend any future fuel tax or vehicle fee. Supervisor Brown requested to be added as a co-sponsor.

Final maps were approved for 1335 Folsom Street and Treasure Island.

The Board approved Final Map 9379 for a mixed-use condominium project at 1335 Folsom Street. Also, the Board approved phased Final Map No. 9235 relating to portions of Treasure Island.

The Board concurred in the Second Declaration of Local Emergency for flooding affecting SFPUC’s Moccasin Reservoir.

The Board approved a motion concurring in the “Flooding Affecting SFPUC’s Moccasin Reservoir” Second Declaration of Local Emergency by the Mayor and in the actions taken to meet the emergency.

Resolution supporting California State Proposition 10 was referred to the Land Use and Transportation Committee.

The Board considered a resolution supporting California State Proposition 10, The Affordable Housing Act. After discussion, the Board voted against adopting the resolution. Supervisor Peskin then moved to rescind the previous vote, which carried. Finally, the Board voted to refer the Resolution to the Land Use and Transportation Committee.

Legislation Introduced

Numerous ordinances and resolutions were introduced related to infrastructure financing, street vacations, labor agreements, planning codes, and public health.

The Board introduced several ordinances and resolutions. These included ordinances related to creating Infrastructure and Revitalization Financing District No. 2 (Hoedown Yard, Pier 70), summary street vacation on Michigan Street, street vacations for the Sunnydale HOPE SF Project, amending sidewalk width on portions of Beale, Howard, Main, and Mission Streets, labor peace agreements for excursion vessel operations, fire-damaged liquor stores in North Beach, and bus rapid transit projects. Resolutions included proposing and approving an Infrastructure Financing Plan for District No. 2, authorizing bond issuance, calling a special election, declaring results of the special election, accepting a grant from the San Francisco Parks Alliance, declaring a shelter crisis, funding participation for homeless mentally ill outreach, accepting grants and in-kind gifts for the District Attorney's Office, and resolutions of intent to vacate Sunrise Way and other streets for the Sunnydale HOPE SF Project. Several items were referred for adoption without committee reference: Approval of a 120-Day Extension for Planning Commission Review of Planning Code, Zoning Map, Dr. Raymond Li Day - September 10, 2018 and several items were assigned to committees: non-renewal of historical property contracts, requests for hearings about San Francisco Municipal Transportation Agency, air port noise and city contractors' safety records.
