Meeting on Budget, Tenant Protection, and Public Health Initiatives

The San Francisco Board of Supervisors convened on June 29, 2021, covering a wide range of topics, including budget approvals, tenant protections, and public health initiatives. The Board approved minutes from previous meetings, ordinances concerning compensation for city employees and regulations on food delivery services, and amendments to COVID-19 tenant protection measures. They also addressed budget and salary ordinances for upcoming fiscal years, approved grants for various programs, and continued a hearing related to a conditional use authorization appeal. Committee of the Whole

The Board of Supervisors approved the minutes from the May 18, 2021 regular meeting and the May 19, 2021 special meeting of the Budget and Appropriations Committee.

Supervisor Ronen, seconded by Supervisor Peskin, moved to approve the minutes from the May 18, 2021, Regular Board Meeting and the May 19, 2021, Special Board Meeting at the Budget and Appropriations Committee. There were no corrections requested from any Member of the Board. The motion carried by a vote of 11-0.

Consent Agenda

The Board approved compensation for unrepresented city employees and removed the sunset clause from the Police Code regarding regulations on third-party food delivery services.

The Board unanimously approved Ordinance No. 086-21, sponsored by the Mayor, which fixes compensation for unrepresented City employees, establishing working schedules and other terms and conditions of employment effective July 1, 2021. They also unanimously approved Ordinance No. 097-21, sponsored by Supervisor Peskin, which amends the Police Code to remove the sunset clause from the article imposing a fee cap and other regulations on Third-Party Food Delivery Services.

Consent Agenda

The Board approved an ordinance amending the Administrative Code regarding COVID-19 tenant protections, with an amendment to correct a date.

Supervisor Preston requested that File No. 210601 be severed from the Consent Agenda. Supervisor Haney requested to be added as a co-sponsor. Supervisor Preston, seconded by Supervisor Peskin, moved to amend the Ordinance on Page 5, Line 11, changing '2023' to '2021'. The motion carried unanimously. The amended ordinance was then passed on first reading by a vote of 11-0.

Unfinished Business

The Board approved the proposed interim budget and appropriation ordinance and the interim annual salary ordinance for fiscal years 2021-2022 and 2022-2023, with one dissenting vote.

President Walton requested File Nos. 210641 and 210642 be called together. The Board approved Ordinance No. 095-21, sponsored by the Mayor, appropriating all estimated receipts and expenditures for City departments as of June 1, 2021, for FYs 2021-2022 and 2022-2023, by a vote of 10-1, with Supervisor Preston voting against. They also approved Ordinance No. 096-21, sponsored by the Mayor, enumerating positions in the Annual Budget and Appropriation Ordinance for the same fiscal years, fixing compensations and work schedules, by a vote of 10-1, with Supervisor Preston again dissenting.

New Business

The Board approved a retroactive grant for the Pit Stop Public Toilet Program, a renewal agreement for data center space, and a mutual lease termination agreement.

The Board unanimously adopted Resolution No. 326-21, sponsored by the Mayor, retroactively authorizing Public Works to accept and expend a grant of up to $250,000 from BART for the Pit Stop Public Toilet Program. They also unanimously adopted Resolution No. 327-21, approving a renewal agreement for data center space in Rancho Cordova, CA, for a three-year term. Resolution No. 328-21, approving the mutual termination of Port Lease No. L-8627 between the Port of San Francisco and Ferry Plaza Limited Partnership, was also unanimously adopted.

New Business

The Board approved contract amendments for behavioral health services with Edgewood Center for Children and Families and the Regents of the University of California.

The Board unanimously adopted Resolution No. 329-21, approving Amendment No. 1 to the agreement between Edgewood Center for Children and Families and the Department of Public Health, increasing the agreement by $33,074,459 for a total not to exceed $57,298,967; and extending the term by five years. Supervisor Mar requested to be added as the sponsor. The Board also unanimously adopted Resolution No. 330-21, approving Amendment No. 2 to the agreement between the Regents of the University of California Alliance Health Project and the Department of Public Health, increasing the agreement by $18,654,415 for a total not to exceed $28,604,583; and to extend the term for six years. Supervisor Mandelman was the sponsor.

New Business

The Board approved a retroactive grant for HIV/Tuberculosis strategic information technical assistance.

The Board unanimously adopted Resolution No. 331-21, retroactively authorizing the Department of Public Health to accept and expend a grant amendment to increase the amount by $57,564 for a total of $127,696 from the Centers for Disease Control and Prevention through the Regents of the University of California, San Francisco for participation in a program, entitled “Targeted Human Immunodeficiency Virus/Tuberculosis Strategic Information Technical Assistance for President's Emergency Plan for Acquired Immunodeficiency Syndrome Relief (PEPFAR) and Global Fund to Fight Acquired Immunodeficiency Syndrome, Tuberculosis and Malaria (GFATM) Countries,” for the period of September 30, 2019, through September 29, 2021. Supervisors Mandelman and the Mayor were the sponsors.

Hearing

The Board continued a hearing and associated motions regarding a conditional use authorization appeal for a project at 575 Vermont Street to a future meeting.

President Walton opened the public hearing for File Nos. 210709, 210710, 210711, and 210712, concerning an appeal of a Conditional Use Authorization approval for 575 Vermont Street. He indicated he would make a motion to continue the hearing and associated motions to a future meeting. After inquiring and finding no speakers wishing to address the continuance, Supervisor Walton, seconded by Supervisor Peskin, moved to continue the Hearing to the Board of Supervisors meeting of July 20, 2021. The motion carried unanimously. The motions approving, conditionally disapproving, and directing preparation of findings related to the Conditional Use Authorization were also continued to the July 20, 2021 meeting.

Public Testimony

Members of the public voiced concerns regarding funding for non-profits, public safety, library services, rental assistance, and development projects, as well as gratitude for the free Muni for youth program and concerns about violence at General Hospital.

Numerous members of the public provided comments on a variety of topics. Concerns were raised about funding for certain non-profits, defunding public safety, limited library services, rental assistance programs, and the Planning Commission's handling of public participation. Gratitude was expressed for the free Muni for youth program. Multiple speakers shared concerns about the increase of violent incidents at General Hospital. Some spoke in opposition to motions adopting findings for previously heard appeals, while others supported motions concerning the Francisco Street tentative map appeal. Concerns were also raised regarding City College of San Francisco, Sunshine Ordinance Task Force complaints, homeless services, and the reduction of Muni services. One speaker shared an In Memoriam and encouraged the Board to continue supporting immigrant communities and people of color.

Legislation Introduced

The Board considered a resolution supporting the Repeal of the Spousal Rape Exception Act, appointed Allyson Bravmann to the Park, Recreation and Open Space Advisory Committee, and reversed the categorical exemption determination for a project at 476 Lombard Street.

The Board unanimously adopted Resolution No. 332-21, supporting California State Assembly Bill No. 1171, The Repeal of the Spousal Rape Exception Act. Supervisors Mandelman and Safai requested to be added as co-sponsors. They also approved Motion No. M21-100, adopting findings to reverse the determination by the Planning Department that the proposed project at 476 Lombard Street is categorically exempt from further environmental review. Motion No. M21-101, appointing Allyson Bravmann to the Park, Recreation and Open Space Advisory Committee, and Motion No. M21-102, adopting findings concerning the disapproval of a Tentative Map for 424, 426, 428, 430, 432, and 434 Francisco Street, were also approved.

Legislation Introduced

New ordinances and resolutions were introduced concerning landmark designation, alternate water sources, COVID-19 rent resolution, commercial tenant eviction protections, loan agreements, housing revenue notes and bonds, grants, property purchase and lease agreements, transferable development rights, unionizing security officers, free Muni for youth, and historic preservation review.

A series of new ordinances and resolutions were introduced. These included an ordinance amending the Planning Code to designate 396-398 12th Street (San Francisco Eagle Bar) as a Landmark (File No. 210734), and an ordinance amending the Health, Business and Tax Regulations Codes regarding alternate water sources for non-potable applications (File No. 210536). Further, an ordinance to modify the rules for the COVID-19 Rent Resolution Fund (File No. 210761) and another concerning eviction protections for commercial tenants related to unpaid rent due to COVID-19 financial impacts (File No. 210762) were introduced. Several resolutions were presented concerning loan agreements for affordable housing, multifamily housing revenue notes and bonds, grants from the U.S. Department of Housing and Urban Development, the purchase of real property for homelessness and supportive housing, property lease extensions, the sale of transferable development rights, supporting unionizing CommonSpirit/Dignity Health Security Officers, supporting Free Muni For All Youth, and an approval of a 90-day extension for Historic Preservation Commission Review of Initiation of Landmark Status of The Allegory of California Mural at 155 Sansome Street.

Legislation Introduced

A motion was introduced directing the Budget and Legislative Analyst to conduct performance audits of the Office of Economic and Workforce Development and the Mayor’s Office of Housing and Community Development.

Supervisor Preston introduced a motion (File No. 210779) directing the Budget and Legislative Analyst to conduct performance audits in Fiscal Year (FY) 2021-2022 of the Office of Economic and Workforce Development economic development programs, including Community Grants programs, and Small Business programs and coordination with the Office of Small Business; and Affordable Housing funds administered by the Mayor’s Office of Housing and Community Development, including sources and allowable uses of funds, dedicated and actual use of funds over prior ten year period and available fund balances, and planning, decision-making, and reporting on fund allocations and balances.

A motion was introduced concurring in actions to meet the local emergency related to the Coronavirus response.

Supervisor Walton introduced a motion (File No. 210780) concurring in actions taken by the Mayor in the Thirty-Sixth Supplement to the Proclamation of Emergency to meet the ongoing local emergency related to the novel coronavirus COVID-19 pandemic by extending the expiration date for additional paid sick leave available to City employees during the pandemic from June 30, 2021, to September 30, 2021.

A request for a hearing was introduced regarding the Budget and Legislative Analyst's performance audit of affordable housing development and preservation.

Supervisors Mar and Preston introduced a request for a hearing (File No. 210781) on the findings and recommendations of the Budget and Legislative Analyst's performance audit of the Mayor's Office of Housing and Community Development's policies and procedures for affordable housing development and preservation; and requesting the Budget and Legislative Analyst, Mayor's Office of Housing and Community Development, and the Department of Homelessness and Supportive Housing to report.

Proposed ordinances were introduced regarding settlements of lawsuits against the City and County of San Francisco.

Proposed ordinances were introduced, including one authorizing settlement of the lawsuit filed by Con-Quest Contractors, Inc. against the City and County of San Francisco for $325,000 (File No. 210731). Another authorized settlement of the lawsuit filed by Sean Wendell Moore against the City and County of San Francisco for $3,250,000 (File No. 210732). A third authorized settlement of the lawsuit filed by Colin James Baca against the City and County of San Francisco for $230,000 and settlement of the related Complaint in Intervention of XL Specialty Insurance Company in the amount of $35,000 (File No. 210733).

Proposed resolutions were introduced regarding lease agreements and extensions at the airport and for public health department facilities.

Proposed resolutions were introduced, including one approving a Lease Modification to 2011 Lease and Use Agreement between the City and TACA International Airlines, S.A., extending the term through June 30, 2023, with an estimated rent of $4,301,668 (File No. 210735). Another approved the Harvey Milk Terminal 1 Food and Beverage Concession Lease between ProperFood SFO Airport, LLC, and the City for a term of 12 years with one two-year option, and a minimum annual guarantee of $275,000 for the first year (File No. 210736). Also, a resolution approving and authorizing the Director of Property to amend the lease of real property located at 650-5th Street, with Townsend Associates, LLC, at a base rent of $159,200 per year with 3% annual increases (File No. 210737). Finally, a resolution approving and authorizing the Director of Property to extend the lease of real property located at 555-575 Polk Street, with Mattison Family Trust, at a base rent of $500,364 per year with no annual increases (File No. 210738).
