The Board approved several ordinances authorizing settlements for lawsuits against the City and County of San Francisco. These included: Elizabeth A. Loomis ($275,000 for a trip and fall), William Watkins ($30,000 for an employment dispute), Elvin I. Smith ($500,000 for personal injury on a city street), California State Lands Commission (non-monetary terms regarding public trust findings), Rick Popko and Nancy Huff ($36,000 for property loss due to flooding), Carlos Gross ($88,500 for property loss due to flooding), Fabio Petrolino et al. Consent Agenda

The Board approved amendments to the Electrical and Plumbing Codes, as well as changes to regulations regarding powered scooters.

The board approved an ordinance amending the Electrical Code to correct the title for the Low Voltage Lighting section (Ordinance No. 095-18). Also approved was an ordinance amending the Plumbing Code to prohibit the use of circuit venting unless approved as an alternative engineered design (Ordinance No. 096-18). Furthermore, the Board passed Ordinance No. 099-18 amending the Transportation and Public Works Codes to establish violations for unauthorized parking or abandonment of powered scooters on sidewalks and public rights-of-way. The ordinance differentiates between scooters in permitted share programs and those that are not, outlining enforcement actions for each.

Consent Agenda

The Board approved changes to the Administrative Code regarding traffic stop data, the Family Violence Council, and the Office of Cannabis.

The Board approved an ordinance amending the Administrative Code to repeal local law enforcement data collection and reporting requirements associated with traffic stops, detentions, and arrests, while requiring that data reported to the Attorney General under state law also be reported to the Mayor, Board of Supervisors, Police Commission, and Human Rights Commission (Ordinance No. 097-18). Additionally, the Board approved an ordinance amending the Administrative Code to change the composition of the Family Violence Council and extend its sunset date to May 1, 2021 (Ordinance No. 100-18). Finally, the Board passed Ordinance No. 101-18 amending the Administrative Code to authorize the Director of the Office of Cannabis to access criminal history information for permitting and licensing purposes, and to allow employers to inquire about convictions for decriminalized behavior related to cannabis for the Cannabis Business Equity Incubator Program.

The Board approved the declaration of Italian American Heritage Day in addition to Indigenous Peoples Day.

The Board approved Ordinance No. 098-18 amending the Administrative Code to declare the second Monday in October each year to be Italian American Heritage Day in addition to Indigenous Peoples Day. The vote was 10 in favor, with Supervisor Ronen voting against.

The Board approved a grant for the Public Beach Safety Program.

The Board approved Resolution No. 121-18, retroactively authorizing the Department of Public Health to accept and expend a $30,000 grant from the State Water Resources Control Board for the Public Beach Safety Grant Program for the period of July 1, 2017, through June 30, 2018.

The Board authorized the issuance and sale of various general obligation bonds.

The Board approved resolutions authorizing the issuance and sale of several series of general obligation bonds. Resolution No. 111-18 authorized the issuance and sale of up to $189,735,000 in Tax-Exempt General Obligation Bonds (Earthquake Safety and Emergency Response Bonds, 2014), Series 2018C. Resolution No. 514-16 authorized the issuance and sale of up to $146,000,000 in Taxable General Obligation Bonds (Affordable Housing, 2015), Series 2018D. Resolution No. 113-18 authorized the issuance and sale of up to $52,500,000 in Tax-Exempt General Obligation Bonds (Public Health and Safety, 2016), Series 2018E. All resolutions included provisions for appointing depositories, establishing accounts, and authorizing city officials to take necessary actions for the issuance and sale of the bonds.

The Board approved the issuance of revenue bonds for Presidio Knolls School, Inc.

The Board approved Resolution No. 122-18, authorizing the issuance of revenue bonds or a tax-exempt loan by the California Municipal Finance Authority in an amount not to exceed $40,000,000. The proceeds would be loaned to Presidio Knolls School, Inc., a California nonprofit public benefit corporation, to refinance certain loans, finance acquisition, construction, equipping, and furnishing of facilities at 1415 Howard Street and 220, 230, 240, 250, and 260-10th Street.

The Board approved a reward for information leading to the detection of property tax underpayment.

The Board approved on first reading an ordinance authorizing a reward of $7,095.42 to Natasha Khoruzhenko for providing information that led to the detection of an underpayment of property tax resulting from an unreported change in ownership.

The Board directed the Budget and Legislative Analyst to conduct performance audits of the SFMTA, workforce development programs, and the Office of Economic and Workforce Development.

The Board approved Motion No. M18-058, directing the Budget and Legislative Analyst to conduct three performance audits in FY2018-2019. These audits will focus on: trends in Muni ridership and revenues, and the effectiveness of SFMTA in managing traffic congestion; the effectiveness of the City's workforce development programs for low-income, homeless, and formerly homeless adults; and the Office of Economic and Workforce Development's planning for large-scale development and capital projects to address the economic impacts on surrounding businesses.

The Board continued the ordinance amending the Building Code regarding slope and seismic hazard zone protection.

The Board voted to continue the ordinance amending the Building Code to revise the City’s Slope Protection Act (File No. 171284) to the Board of Supervisors meeting of May 8, 2018. This ordinance seeks to clarify the scope of the Act's application, update map references, mandate review by the Department of Building Inspection’s Structural Advisory Committee, and re-enact and modify a paragraph in the scope section regarding the type of proposed construction that triggers application of the Act.

The Board approved the extension of the Lower Polk Street Alcohol Restricted Use District.

The Board passed on first reading an ordinance amending the Planning Code to extend the Lower Polk Street Alcohol Restricted Use District to June 1, 2023. This ordinance also expands the circumstances under which temporary closures of liquor establishments are not considered abandonment of such uses, provided that any demolition permits required for the repair, renovation, or remodeling work have been submitted by January 1, 2018.

The Board approved a list of projects to be funded with FY2018-2019 Road Maintenance and Rehabilitation Account funds.

The Board heard an appeal of a Conditional Use Authorization for a project at 799 Castro Street and 3878-3880 21st Street.

The Board held a hearing on the appeal of a Conditional Use Authorization for a proposed project at 799 Castro Street and 3878-3880 21st Street (Case No. 2017-004562CUA). The project involves demolishing a residential unit and constructing a three-story over basement single-family residence within an RH-2 Zoning District, with a new accessory dwelling unit. Ryan Patterson, Mike Garibaldi, and Andrew Zacks (on behalf of the Appellants) argued for approval of the appeal. Pat Busgavich and Kat Taylor supported the appeal. Aaron Starr (Planning Department) and Heidi Gewertz (City Attorney) provided an overview of the Planning Department's decision. Hatef Moghimi and Ahmad Mohazab (on behalf of the Project Sponsor) requested the Board uphold the Planning Commission's decision. Jennifer Leader and James Scraetch spoke in opposition to the appeal. The Board ultimately voted to approve the decision of the Planning Commission by its Motion No. 20118, approving the Conditional Use Authorization. Motions to conditionally disapprove the decision of the Planning Commission and to prepare findings related to the disapproval were tabled.

The Board heard an appeal regarding the disapproval of a condominium conversion subdivision map application at 668-678 Page Street.

The Board held a hearing regarding the disapproval of an application for a land subdivision to convert a three-story, six-unit building into residential condominiums at 668-678 Page Street. Geoffery Pierce and Sarah Hoffman (on behalf of the Appellants) argued for approval of the appeal. Bruce Storrs (Public Works), Aaron Starr and David Weissglass (Planning Department) provided an overview of the decisions of Public Works and the Planning Department. A number of speakers (Charles Minster, Tommi Avicolli Mecca, Tony Robles, Susan Prentice, Deepa Varma, Theresa Flandrich, David Bogachik, Fran Taylor, Iris Biblowitz, Kathy Lipscomb, Karen Reskin, Iris Merrious, Zion Angeles, Devon Garcia, Tyler Breisacher, Josh Bourgeois, TJ Bassa, Laura Breslin, Susan Marsh, Lila Stamann, Curtis Bradford, Guss Brown, Andy Gellis, Betty Trainor, Tom Gilberty) spoke in opposition to the appeal. The board voted to approve the decision of Public Works and disapprove the Tentative Map Application. Motions to conditionally disapprove the decision of Public Works and approve the Tentative Map Application, and to prepare findings related to the Tentative Map, were tabled. The motion to approve the decision of Public Works carried with 10 votes in favor and 1 vote against (Tang).

The Board approved the list of agencies qualified to participate in the 2018 Annual Joint Fundraising Drive.

The Board approved Resolution No. 120-18, designating those agencies qualified to participate in the 2018 Annual Joint Fundraising Drive for officers and employees of the City and County of San Francisco.

The Board approved the extension of time deadlines for mandatory disability access improvements for places of public accommodation and deletion of an administrative fee.

The Board passed on first reading an ordinance amending the Building Code to extend the times for existing buildings with a place of public accommodation either to have all primary entries and paths of travel into the building accessible to persons with disabilities or to receive a City determination of equivalent facilitation, technical infeasibility, or unreasonable hardship. It extends the period for granting extensions, extends the time to submit the Department of Building Inspection's report on the disability access improvements program, eliminates the administrative fee, and restates the findings of local conditions under the California Health and Safety Code.

Members of the public voiced a variety of concerns.

Members of the public shared concerns regarding street cleanliness, religious matters, transportation gridlock, medical cannabis access, the Police Officers Association, taxi medallion holders, Senate Bill 1045, treatment of detainees by Customs and Border Protection, and the lack of assistance for those with mental illness.
