The Board President announced changes to the meeting agenda.

President Yee announced that Item 16 (File No. 200036) would be continued to a later date. Item 25 (File No. 200282) may be severed and amended to request a Committee of the Whole hearing today to ensure an expeditious delivery of information to the public on the local health emergency. Item 27 (File No. 200288) is an Imperative Agenda Motion to convene in Closed Session today with various Department Heads regarding the potential threats to public service and facilities.

Consent Agenda

The Board passed an ordinance related to Medical Examiner reports of drug overdose deaths.

The Board passed an ordinance amending the Health Code to require the Medical Examiner to report information to the Mayor, Board of Supervisors, and Director of Health once every four months regarding deaths arising from drug overdoses, sponsored by Supervisors Haney, Walton, Ronen, Fewer and Mar.

Consent Agenda

The Board passed an ordinance delegating authority for applications for discharge from accountability for taxes on unsecured property to the Controller.

The Board passed an ordinance amending the Administrative Code to delegate authority from the Board of Supervisors to the Controller, under California Government Code, Section 25259.5, to grant applications for discharge from accountability filed by the Tax Collector for the collection of any delinquent taxes on unsecured property.

The Board approved lease agreements for food and beverage kiosks at Harvey Milk Terminal 1 and Terminal 3.

The Board approved a resolution for Lease No. 19-0244 between Park Café Group, Inc., as tenant, and the City and County of San Francisco, acting by and through its Airport Commission, for a term of ten years and a minimum annual guarantee of $240,000 for the first year of the Lease, to commence following Board approval. It also approved a resolution for Lease No. 19-0245 between Sidewalk Juice, SFO, LLC, as tenant, and the City and County of San Francisco, acting by and through its Airport Commission, for a term of ten years and a minimum annual guarantee of $136,000 for the first year of the Lease, to commence following Board approval, and Lease No.19-0247 between Elevate Gourmet Brands-SC Group, a joint venture between Elevate Gourmet Brands, Inc. and Skyview Concessions, Inc., as joint tenants, and the City and County of San Francisco, acting by and through its Airport Commission, for a term of ten years and a minimum annual guarantee of $250,000 for the first year of the Lease, to commence following Board approval.

The Board approved a lease of real property at 1156 Valencia Street from The Salvation Army for the Department of Public Health.

The Board approved a resolution authorizing the Director of Property, on behalf of the Department of Public Health, to lease real property located at 1156 Valencia Street from The Salvation Army at an initial base rent of $404,000 per year, for a term of three years with two one-year options to extend, authorizing the reimbursement of $300,000 towards the cost of Leasehold Improvements.

The Board approved accepting and expending a grant for the creation of a psychiatric respite center.

The Board approved a resolution retroactively authorizing the Department of Public Health to accept and expend a grant in the amount of $3,000,000 from the Tipping Point Community to participate in a program, entitled "HB MH1921 HMM104 Hummingbird Place - Tipping Point," for the creation of a new psychiatric respite center, for a two year period beginning January 16, 2020, through January 15, 2022.

The Board approved a resolution authorizing the San Francisco Police Department (SFPD) to accept and expend a grant in the amount of $65,828 from the State of California, Department of Parks and Recreation, Division of Boating and Waterways for the SFPD Marine Unit to procure equipment and gear for the project period to commence following Board approval through November 30, 2020.

The Board approved a resolution authorizing the issuance and delivery of multifamily housing revenue bonds in an aggregate principal amount not to exceed $37,109,907 for the purpose of providing financing for the acquisition and rehabilitation of a 108-unit affordable multifamily rental housing project, consisting of three structures located at 22, 102, and 104-106 South Park Street.

The Board adopted a resolution urging the administrative staff of the Department of Public Health to include frontline Registered Nurses and Resident Physicians in their decision-making process, to implement an expedited hiring process, to reduce reliance on Contract Registered Nurses, to provide annual violence prevention and disaster-preparedness training, and to support its bilingual staff.

The Board passed on first reading an ordinance amending the Police Code to make an existing exemption to the Paid Parental Leave Ordinance for employers with fully paid family leave policies consistent with recent changes to state law.

The Board passed on first reading an ordinance amending the Administrative Code to require that Mayoral and Board of Supervisors appointments to the Reentry Council expire following a member’s hiring at designated City departments, increase the number of Reentry Council officers from four to five and require that the fifth officer be a formerly incarcerated member, and increase from 12 to 13 the number of members that constitute a quorum.

The Board continued the Committee of the Whole hearing on law enforcement staffing numbers to April 14, 2020.

President Yee opened the public hearing on findings and recommendations regarding police staffing citywide and indicated a motion would be made to continue this hearing to a later date. Supervisor Walton, seconded by Supervisor Ronen, moved that this Hearing be CONTINUED to the Board of Supervisors meeting of April 14, 2020. The motion carried.

Public Testimony

The Board heard public comment.

Two speakers addressed the Board. One shared religious and political views. The other provided suggestions on the local health emergency, including a fixed time for public comment, virtual town hall meetings, DCCC resignation, and senior citizen shopping hours.

Supervisor Ronen requested that File No. 200282 be severed. The Board then approved, as amended, a motion directing the Clerk to schedule a Committee of the Whole hearing on March 17, 2020, for Departments to report regarding city preparations in response to the COVID-19 health emergency. Changes were made to amend the original date of March 19th, 2020 to March 17th, 2020 and to strike references to the time 11:00am.

The board looked to concur actions taken by the Mayor related to the Coronavirus pandemic. After some discussion and privilege being granted to the floor, the motion was initially approved before being rescinded and continued to the Board of Supervisors meeting of March 24, 2020.

President Yee opened the public hearing and Supervisor Ronen provided remarks. Department heads provided an overview of the COVID-19 local health emergency and responded to questions. There were no public speakers. The Board adjourned as a Committee of the Whole and reconvened as the Board of Supervisors. The motion that this Hearing be HEARD AND FILED was carried.

An ordinance authorizing settlement of a lawsuit filed by Henry McKenzie against the City and County of San Francisco was introduced and assigned to the Government Audit and Oversight Committee.

The City Attorney introduced an ordinance authorizing settlement of the lawsuit filed by Henry McKenzie against the City and County of San Francisco for $400,000; the lawsuit was filed on November 24, 2018, in the United States District Court Northern District of California, Case No. 4:18-cv-7141 DMR; entitled Henry McKenzie v. City and County of San Francisco, et al.; the lawsuit involves an employment dispute.
