President Peskin asked if there were any corrections to the February 6th minutes. Hearing none, Supervisor Mandelman moved to approve them, seconded by Supervisor Walton. After public comment, the motion passed with 10 ayes and Supervisor Ronen excused.

Committee of the Whole

Mayor Breed addressed the Board regarding housing for undocumented immigrants, homelessness, and long-term housing plans.

Mayor London Breed discussed housing for undocumented immigrants, a proposal coming before the board, reallocation of funds by the Department of Homelessness and Supportive Housing to open new family shelters, and long-term housing plans to ensure no children or families are sleeping on the streets. She urged support for future policy changes. The matter was filed with no further action after public comment.

Consent Agenda

The Board passed an ordinance requiring annual transient occupancy tax returns for short-term rental hosts not using qualified websites.

Ordinance 240036 amended the Business and Tax Regulations Code to mandate annual filing of transient occupancy tax returns for short-term rental hosts not using qualified websites (starting January 1, 2024). It also waived the requirement for these hosts to obtain a certificate of authority, changed the filing period for hotel small operators (excluding short-term rental hosts) to monthly, codified the qualified website company program, and required these companies to collect and remit Tourism Improvement District assessments. The ordinance passed finally.

The Board approved an ordinance allowing microtrenching for fiber-optic facility installation.

Ordinance 230867, sponsored by Supervisors Safai and Engardio, amended the Public Works Code to allow microtrenching for installing fiber-optic facilities. The Planning Department's determination under CEQA was affirmed. The ordinance passed finally.

The Board passed an ordinance encouraging housing production by exempting certain projects from notice and review procedures.

Ordinance 231258, sponsored by the Mayor and Supervisor Melgar, amended the Planning Code to encourage housing production by exempting specific housing projects from Section 311 notice and review procedures in areas outside Priority Equity Geographies. It also removed the Conditional Use requirement for housing developments on large lots outside these areas. CEQA was affirmed, and findings of consistency with the General Plan and priority policies were made. The ordinance passed finally.

Ordinance 240169, sponsored by Supervisor Chan and others, amended the Planning Code to require Conditional Use authorizations for establishing Parcel Delivery Service uses, prohibiting Non-Cannabis Parcel Delivery Service as an accessory use, and revising zoning control tables. CEQA was affirmed, and findings of public necessity and consistency were made. The ordinance passed finally.

The Board approved an ordinance clarifying the Controller’s audit responsibilities for nonprofits contracting with the City.

Ordinance 230973, sponsored by Supervisor Stefani and others, amended the Administrative Code to clarify the Controller's audit and monitoring responsibilities for nonprofits contracting with the City. It directed the Controller to establish measurable performance goals, review policies regarding contractor compliance, and perform an annual review of departments' compliance with auditing policies. Supervisor Dorsey was added as a co-sponsor. The ordinance passed finally.

The Board approved an ordinance renaming and expanding the Family Housing Opportunity Special Use District.

Ordinance 230808, sponsored by Supervisor Melgar and Supervisor Engardio, amended the Planning Code to rename the Family Housing Opportunity Special Use District to the Family and Senior Housing Opportunity Special Use District. It authorized increased unit density on Corner Lots within the district and extended benefits to other residential districts within the area bounded by the Great Highway, Lincoln Way, 19th Avenue, and Sloat Boulevard, and refined project eligibility criteria in the SUD, and amended the Zoning Map. CEQA was affirmed, and findings of consistency and public necessity were made. The ordinance passed finally.

The Board approved an ordinance establishing a Forgivable Loan for First-Time Homebuyers Program.

Ordinance 230864, sponsored by Supervisor Melgar and others, amended the Administrative Code to establish the Forgivable Loan for First-Time Homebuyers Program and Fund to assist low, moderate, and middle-income first-time homebuyers. It required the Human Rights Commission, in consultation with the Mayor’s Office of Housing and Community Development, to establish policies and procedures for issuing and forgiving loans. Supervisor Safai was added as a co-sponsor. The ordinance passed finally, with Supervisor Peskin voting no.

The Board approved an ordinance amending the General Plan to facilitate the Potrero Bus Yard Project.

Ordinance 240047 amended the Urban Design Element of the General Plan to facilitate the Potrero Bus Yard Project, adopting findings under CEQA, and making findings of consistency and public necessity. It was presented following Planning Commission recommendation. The ordinance passed finally.

The Board approved an ordinance creating the Potrero Yard Special Use District and changing height and bulk limits.

Ordinance 231256, sponsored by Supervisors Ronen and Walton, amended the Planning Code and Zoning Map to create the Potrero Yard Special Use District and change height and bulk limits at 2500 Mariposa Street to facilitate the Potrero Yard Modernization Project. Findings were adopted under CEQA and of consistency and public necessity. The ordinance passed finally.

New Business

The Board approved the first reading of an ordinance appropriating funds from the issuance of Refunding General Obligation Bonds and a resolution for their issuance and sale.

Ordinance 240086, sponsored by the Mayor, appropriated $644,675,000 from the issuance of Refunding General Obligation Bonds and placed them on Controller's reserve in FY 2023-2024. Resolution 240114, also sponsored by the Mayor, approved the issuance and sale of these bonds, ratified prior actions, and granted authority to City officials. Both passed on first reading and were adopted respectively.

New Business

The Board approved a resolution to accept and expend a grant for the Children’s Health Center’s HealthySteps Program.

Resolution 240060, sponsored by the Mayor, retroactively authorized the Department of Public Health to accept and expend a grant of $373,084.11 from the San Francisco General Hospital Foundation for participation in the "Children’s Health Center’s HealthySteps" program from November 1, 2023, through June 30, 2024. The resolution was adopted.

New Business

The Board approved a resolution retroactively approving an amendment to a Property Exchange Agreement regarding 530 Sansome Street.

Resolution 240064, sponsored by Supervisor Peskin, retroactively approved a second amendment to the Conditional Property Exchange Agreement with EQX Jackson SQ Holdco LLC to extend the anticipated initial closing date to December 15, 2026, for a transfer of City real property at 530 Sansome Street in exchange for a portion of the property at 425-439 Washington Street. The resolution also authorized the Director of Property and City staff to proceed with the proposed Fire Station development project and to enter into modifications to the agreement. The resolution was adopted.

The Board approved a resolution to accept and expend a grant for Predictive Analytics AI/ML at San Francisco General Hospital.

Resolution 240130, sponsored by the Mayor, retroactively authorized the Department of Public Health to accept and expend a grant of $212,500 from the San Francisco General Hospital Foundation for participation in the "Predictive Analytics AI/ML" program from July 1, 2023, through June 30, 2028. The resolution was adopted.

The Board approved the first reading of an ordinance designating the Sacred Heart Parish Complex as a Landmark.

The Board approved the first reading of an ordinance waiving Conditional Use Authorization requirements for removing unauthorized units under certain conditions.

Ordinance 231185, sponsored by Supervisor Melgar and co-sponsored by Supervisors Peskin and Mandelman, amended the Planning Code to waive Conditional Use Authorization requirements for removing unauthorized units in single-family homes where the owner meets specific criteria and amended the Administrative Code to require that if an owner obtains an exemption from the Conditional Use Authorization requirement to remove an unauthorized unit, the single-family home shall be subject to the rent increase limitations of the Rent Ordinance. Supervisor Mandelman requested to be added as a co-sponsor. The ordinance passed first reading.

The Board approved the first reading of an ordinance creating the Legacy Business Assistance Program.

Ordinance 240088, sponsored by the Mayor and others, amended the Administrative Code to create the Legacy Business Assistance Program. Supervisors Mandelman, Preston, and Melgar requested to be added as co-sponsors. The ordinance passed first reading.

New Business

The Board approved the appointment of several individuals to the Immigrant Rights Commission.

Motion 24-022 approved the appointments of Aseel Fara, Mario Paz, Celine Kennelly, Yu Pok Ng, Sarah Souza, and Lucia Obregon to the Immigrant Rights Commission, with terms ending June 6, 2025. Paz's residency requirement was waived. The motion was approved.

The Board recognized several individuals and organizations with Certificates of Honor.

President Peskin presented a Certificate of Honor to Liyan Torres, Ambassador to Cuba. Supervisor Dorsey presented a Certificate of Honor to One Treasure Island, accepted by Sherry Williams. Supervisor Safai presented Certificates of Honor to Monique Guidry, Delia Fitzpatrick, Mary Evelyn Thomas, Renee Underwood, Margie Stokes, and Staci Collins, African American Early Childhood Educators.

The Board adopted a resolution approving a Tolling Agreement regarding a property dispute in Kern County.

Resolution 240082 retroactively approved a Tolling Agreement to extend the statute of limitations for the City and Chevron U.S.A. Holdings Inc. and Chevron U.S.A. Inc. to bring potential litigation regarding the condition of City property in Kern County previously leased by Chevron, to allow for possible resolution. The resolution was adopted.

The Board approved the first reading of an ordinance regarding state-mandated Accessory Dwelling Unit controls.

Ordinance 230310, sponsored by the Mayor, amended the Administrative Code, Building Code, Business and Tax Regulations Code, and Planning Code to clarify the ministerial approval process for certain Accessory Dwelling Units (ADUs). The ordinance passed first reading.
