Meeting on Zoning, Ethics, and Budgetary Matters

Unfinished Business

The Geary-Masonic Special Use District was established.

The Board approved Ordinance No. 045-18, establishing the Geary-Masonic Special Use District, bounded by Geary Boulevard, Masonic Avenue, and Assessor’s Parcel Block No. 1071, Lot Nos. 001 and 004. The ordinance amends the Planning Code and Zoning Map, affirms the Planning Department’s CEQA determination, and makes findings of consistency with the General Plan and Planning Code Section 101.1, and findings of public convenience, necessity, and welfare under Planning Code, Section 302. Sponsors were Supervisors Stefani and Safai.

Unfinished Business

Regulations for restaurant and bar uses in Jackson Square, Broadway, and North Beach were approved.

The Board approved Ordinance No. 047-18, amending the Planning Code to regulate restaurant and bar uses in the Jackson Square Special Use District, Broadway Neighborhood Commercial District, North Beach Neighborhood Commercial District, and North Beach Special Use District. It requires a conditional use permit for Office Uses, Business Services, and Institutional Uses fronting on Pacific Avenue in the Jackson Square Special Use District, and makes findings of public necessity, convenience, and welfare under Planning Code, Section 302. Sponsor was Supervisor Peskin.

Unfinished Business

Requirements for filing Form 700s, Sunshine Ordinance Declarations, and Certificates of Ethics Training were modified for City board and commission members.

The Board approved Ordinance No. 046-18, amending the Campaign and Governmental Conduct Code to disqualify members of City boards and commissions who have not filed their Form 700s (Statements of Economic Interests), Sunshine Ordinance Declarations, and Certificates of Ethics Training from participating in or voting on matters before their boards and commissions, and to modify the Ethics Commission’s reporting requirements regarding the filing of Form 700s. (Ethics Commission). Sponsor was Supervisor Peskin.

New Business

The transfer of a liquor license to Sav More Market was approved.

The Board adopted Resolution No. 058-18, determining that the transfer of a Type-21 off-sale general beer, wine, and distilled spirits license to Abdalla F. Joseph, doing business as Sav More Market located at 4522-3rd Street (District 10), will serve the public convenience or necessity of the City and County of San Francisco, in accordance with California Business and Professions Code, Section 23958.4.

New Business

Verification of preapplication meeting completion for a liquor license at Tato was approved.

The Board approved Motion No. M18-027, verifying that Kristin Anne Houk, doing business as Tato, located at 4608 Third Street, has completed the preapplication meeting requirement under California Business and Professions Code, Section 23826.13, for the issuance of a new, non-transferable, Type-87 neighborhood-restricted special on-sale general liquor license. Sponsor was Supervisor Cohen.

New Business

Investigation fees were waived and refunded for persons registered with the Office of Cannabis.

The board passed on the first reading an ordinance waiving and refunding investigation fees imposed by Building Code, Section 107A.5, for persons registered with the Office of Cannabis. Vote: Ayes: 10 - Breed, Cohen, Fewer, Kim, Peskin, Ronen, Safai, Sheehy, Stefani, Yee; Noes: 1 - Tang. Sponsor was Supervisor Sheehy.

Remarks

Certificates of Honor were presented to several individuals.

The board suspended Rule 5.36 to grant privilege of the floor to the following guests. Supervisor Stefani presented a Certificate of Honor to the Honorable Hans-Werner Tovar, President of the City Council (City of Kiel, Germany). Supervisor Kim presented a Certificate of Honor to Luis Herrera, former City Librarian (San Francisco Public Library). Supervisor Peskin presented a Certificate of Honor to Cynthia Goldstein, Executive Director (Board of Appeals).

Public Testimony

Members of the public shared concerns regarding the election, housing crisis, and religious issues.

The Board voiced support for public sector unions in San Francisco.

The Board adopted Resolution No. 060-18, urging the Mayor and the Department of Human Resources to work with the public sector unions in San Francisco to ensure their health and success; and supporting the freedom of city employees to participate in strong unions post a United States Supreme Court decision on Janus v. AFSCME. Sponsors: Ronen; Fewer, Peskin, Sheehy, Kim, Yee, Safai, Cohen, Breed and Stefani. Supervisor Stefani was added as a co-sponsor.

New Business

The Board declared support for the "March for Our Lives" for common sense gun reform.

The Board adopted Resolution No. 062-18, declaring support for the March 24, 2018, "March for Our Lives" for common sense gun reform and commending the students in San Francisco and around the nation for leading a movement to demand common sense gun laws and school safety measures. Sponsors: Stefani; Safai, Kim, Sheehy, Ronen, Cohen, Yee, Fewer, Tang and Breed. Supervisors Tang and Breed requested to be added as co-sponsors.

New Business

Final Map 8840 for 1198 Valencia Street was approved.

The Board approved Motion No. M18-028, approving Final Map 8840, a 49 residential unit and 5 commercial unit, mixed-use condominium project, located at 1198 Valencia Street, being a subdivision of Assessor’s Parcel Block No. 3635, Lot No. 014; and adopting findings pursuant to the General Plan, and the eight priority policies of Planning Code, Section 101.1.

The Board urged the State Legislative Delegation to introduce legislation to enable San Francisco to impose Infrastructure Impact Fees on Transportation Network Companies.

The Board scheduled a Committee of the Whole joint meeting with the San Francisco Ethics Commission to discuss the Anti-Corruption and Accountability Ordinance.

The Board approved Motion No. M18-029, as amended, calling from the Budget and Finance Committee, pursuant to Board Rule 3.37, the proposed Ordinance (File No. 180001) - the Anti-Corruption and Accountability Ordinance - amending the Campaign and Governmental Conduct Code to institute various campaign finance and conflict of interest reforms; and scheduling the Board of Supervisors to sit as a Committee of the Whole on April 3, 2018, at 3:00 p.m., in a joint meeting with the San Francisco Ethics Commission, to hold a public hearing to consider the proposed Ordinance (File No. 180001).

An ordinance was introduced to address unauthorized motorized scooter violations.

Supervisor Peskin introduced Ordinance 180214, amending the Transportation Code and Public Works Code to address violations related to unauthorized motorized scooters that are parked, left standing, or left unattended on a sidewalk, street, or public right-of-way under the jurisdiction of the Municipal Transportation Agency (MTA) or Department of Public Works (DPW) without an MTA-issued permit. It was assigned to the Land Use and Transportation Committee.

Legislation Introduced

An ordinance was introduced to require disclosure regarding ballot measures involving Port public trust property.

Supervisor Peskin introduced Ordinance 180215, amending the Municipal Elections Code to require a notice in the voter information pamphlet for measures that would approve a development project or a substantial land use or zoning change on land held subject to the public trust by the City, acting by and through the Port Commission. It was assigned to the Rules Committee.

Supervisor Kim introduced Resolution 180218, authorizing the issuance and sale of multifamily housing revenue bonds in an aggregate principal amount not to exceed $45,000,000 for the purpose of providing financing for the acquisition and rehabilitation of a 100-unit multifamily rental housing project known as “Dorothy Day Community Apartments.” It was assigned to the Budget and Finance Sub-Committee.
